I am a man and I am separated from my wife, but the children live with me. Can I change my children’s surname?

If your children are younger than 16 years old and you were previously married, it is likely that you can only change your children’s names if your wife consents.  In order to change your children’s names, you must have Parental Responsibility for them, and there are strict rules for deciding who exactly has Parental Responsibility.  All of the rules on Parental Responsibility are set out on this website – just go to the relevant page by clicking on “Parental Responsibility” in the Deed Poll Information list at the top left of this page.
